Title V of the 1990 Clean Air Amendments established a federal operating permits program to be administered by the states under the rules established by state agencies and approved by the Environmental Protection Agency. All stationary sources of air emissions that have potential emission levels greater than an established threshold amount need a Title V Permit. The deadlines for initial Title V permit applications from existing sources have passed, but permit renewals are imminent. In addition to the renewal applications required every five years, facilities must modify their Title V permits if there is any new construction or additions to the facility, or if any changes in facility operations are made.

The Title V program has shifted the burden of demonstrating Title V compliance and certification from the regulatory agency to the actual facility. For most facilities compliance demonstration and certification is an extreme hurdle depending on company processes, regulatory requirements, and the efficiency of record keeping and reporting methods.
